I personally can not support any organization that can ignore Human Right law. Law that has evolved to protect the citizens from their National authorities ... That I refuse to support an arrogant organization, that refuse to accept Human Right case-law and findings is a position I take from principle .... Principles are not always comfortable or advantageous ...

If you wish to keep bringing it back to where the infringement originated this will go around in circles ....

My issue is that an organization can ban any advertising without "Established" grounds ....

Would you be the same if it was condoms?

If there was ban in the US for something I didn't want to be banned. I would protest, I would write letters, I would do whatever I could to get it changed. I would not vote for Georgia to leave the US and become a sovereign nation. Because that would be really stupid and it would open up a world of problems far worse that a stupid advert. It doesn't matter if it's condoms or smoking or whatever. What matters is that it's a really really dumb reason to leave the EU considering the consequences. And it's not a human right.

This is the West ... when the West ignore their own safeguards they lose the high ground they believe they have.

If you can ban the advertising/promotion of one product without "Established" grounds you can't critisize another nation doing the same ...

The ECHR has several requirements for banning freedom of expression, which includes advertising, one is "Established" or "Necessary" another is "Proportionate" they all fail, but if they don't fail then this could be applied to condoms, medicine. etc ....

If you can just have an opinion to ban advertising we are in a bad place ...

Note discussing a product positively is advertising ...

We are a nation that ratified the ECHR in the fifties, we are bound by that Convention ..... That Convention states that it is always above new treaties.

We didn't join the EU until the "70's" they are now imposing legislation that violates our earlier treaty with the threat of sanctions until we violate that earlier treaty ...

The UK can't afford to violate the EU, so they just play ball and ignore their earlier treaties ....

I have complained and had these complaints accepted (declared admissible) by the European Parliament but they take several years even to look at them .... But note they are judging on their own actions  Dodgy

It's in limbo as we transition to a country with less fucked up laws regarding the same.  Legal-ish.  Federal law still conflates it with coke or heroin - but they don't plan on enforcing.  Half the states have decriminalized but still retain the ability to prosecute if they so choose.  4 states have accepted recreational use but enacted a state controlled price fixing, taxation, and protectionism scheme.  

Meanwhile our for profit prisons are bursting - literally- with "offenders" regardless of the status of our laws. I'd get away with a fine and a reprimand, but I'm an educated white land owner that can manage a thick drawl when pressed.......so...that's not really representative.
