Should this womans past matter?

RE: Should this womans past matter?
Yea I don't know what to think about the sex offender list. It's hard for me to be open minded because if someone raped a child I could never trust them around my children regardless of time served or medical treatment or rehabilitation. But peeing in public or statutory rape (in most cases) shouldn't land you on the list.

But it does. Which begs the question which is more untrustworthy. The one doing it or the system putting them on the list. It's the medieval system of branding someone if they committed a crime. Only instead of hot irons, computer files are all the rage right now.

The thing is, you've got to put the safety of the public first. In my opinion, anyway.

I totally agree that no one should automatically be written of because of their past, but it should be among the factors that are considered.

It takes a certain kind of person to be capable of something like murder or rape, so I feel we should be very sure that they are no longer the same person before we expose the public to them again. I'm talking in general now, not this case in particular.

Of course murder is a lot different from manslaughter. Sometimes I hear a murder verdict in a case and I'm puzzled as to how it wasn't just manslaughter. To me, murder requires some level of premeditation.

I'm inclined to agree on the issue of rape. But murder doesn't. Everyone saying so, isn't honest with themselves and doesn't know the majority of murder cases are family disputes getting out of hand.

Well, it sounds to me like you would be describing manslaughter. If it's done in the heat of the moment, then I would never call it murder. The law might disagree of course. And if there's any element of self preservation (or the preservation of others) then that's a big mitigating factor.

Or are you saying lots of plotted murders go on among families? I would have thought that either you are messed up in the head to do this, or else the conditions you are in have got to you and you're not in your right mind anymore. The latter case is certainly a condition for leniency in the future.

Most. That's why the police usually puts the immediate family under close scrutiniy whenever a murder is committed. Only when they can rule them out, they further their line of inquiry. But don't believe me, look up their procedures.

And be honest with yourself. If you never felt like killing someone, you're probably a rare exception. I certainly did. I just didn't act on it. And not for moral reasons.

I'm not calling you a liar, I'm just surprised. I knew that it was often within the family, but if most of these are cold blooded murder without some sort of pressure cooker environment, that's shocking to me.

No, I've never felt at all like killing anyone, except myself. I wasn't aware it was a common feeling. I am very abnormal in lots of ways, so I guess I shouldn't be so surprised.

I didn't feel as if you were caling me a liar. I just advised to look up the actual expert opinions.

Sure, I'll do some research. It seems I'm hopelessly naive, which is usual for me.

I hate my parents for all the abuse they inflicted on me, and my brothers, and that's just the stuff I can remember. But I never felt like killing them. Just wanting to get away from them. My wife is constantly telling me how weird I am, and that I don't "react how normal people do" to things.

There's no way in heck this woman should have costudy. She's obviously mentally ill and needs help. I would suggest weekly supervised visitation in public with an officer on standby.
