Judge dismisses case of cop sexually assaulting 4 year old girl
February 14, 2016 at 12:52 am
http://thefreethoughtproject.com/judge-d...jail-year/
Summary:
Four year old girl who had a tramatic experience is the only person asked to testify in case of sexual assault, where forensics proved that the cop on trial was in fact the person who raped her. She has trouble speaking, and the dad tries to correct her when asked to identify the person who did it from what was thought to be said; "I don't know", to what was actually said; "I don't want to look at him". Judge gets angry that the Dad spoke out of turn, throws him out of court. Dad swears and is angry about being thrown out of court, and for swearing is charged with one year jail sentence. The case is dismissed on grounds of the girl "Not being able to give a full detailed description".
Aside from the judge dismissing a case with incredibly clear-cut evidence that should warrant the cop's arrest;
I don't know what shocks me more:
The fact that the only person asked to testify was not the doctor who confirmed she had been raped, or the nurse, but the girl herself at a meer four years old.
or
The fact that a judge can give you a year jail sentence for cursing.
Discuss.
Which is better:
To die with ignorance, or to live with intelligence?
Truth doesn't accommodate to personal opinions.
The choice is yours.

Decisions like this make me lose faith in our justice system. What little is left.

And the DA and Judge Sheets are both partners at the same Law Firm. At least he'll be tried for lewd molestation. That little girl should have never been allowed to be questioned. That was ridiculous.
That said, even in this terrible situation, you can't coach a witness from the public area or interpret what she's saying, and when told to be quiet, you can't cuss out the judge. And then, when hauled up before said judge, you're going to jail if you cuss him out again in front of an entire courtroom.

Whilst I agree that insulting a judge is a bad idea, no judge should be able to give apparently arbitrary sentences for swearing. A year is ridiculous. It should be a day, tops. Put him in the cells, give him a few hours to calm down, and ask him if he wants to apologize. If he refuses, keep him in overnight.

Corruption at its finest. I have seen firsthand the trauma that one has to deal with when dealing with the judicial system. At the very least the child's family need to be filing a complaint with the Board of Judicial Review. Not only against the judge, but the prosecutor as well given that this represented a clear conflict of interest.

No doubt. A year is absolutely stupid. Also, there is something to be said for a "crime of passion" in this instance, I would be livid at this judge were it my daughter, and would have a very difficult time controlling myself.

Agreed. His little daughter had been raped. Not like he was in a right frame of mind. This judge was completely unsympathetic to the entire case. Disgusting.

The judge misinterpreted the FOUR YEAR OLD CHILD WHO HAD JUST BEEN SEXUALLY ASSAULTED. Yet he's not willing to cut the guy any slack for trying to, in reality, help the judge make the decision faster, and provide clarity in the case.
You're going to say "That's not how it works". I get it. But the judge is not a robot, he's a person too. I would understand completely if the defendent pointed it out as against the rules of the court, and the judge was made to enforce it. However that's not the case, and there was no reason to point it out regardless of the rules, it's not like he's breaking the rules by not enforcing it, not directly at least.
I don't know what to say really. I know it's his job to enforce the rules. But I just feel like we've lost our sympathy.
