Bottom line is he didn't destroy anything. People merely got pissed that he took a picture making it look like Jesus was giving him a blowjob. SO THE FUCK WHAT?
If we arrest everyone who offends others the makers of South Park would be in prison.

That's idolatry.

Yes.
Quote:The United States Supreme Court in Texas v. Johnson, 491 U.S. 397 (1989), and reaffirmed in U.S. v. Eichman, 496 U.S. 310 (1990), has ruled that due to the First Amendment to the United States Constitution, it is unconstitutional for a government (whether federal, state, or municipality) to prohibit the desecration of a flag, due to its status as "symbolic speech."
BTW, the people who "own" the statue are not the ones filing the charge.
You can desecrate your own American Flag. If you take my American flag and burn it.....your could be charged with theft, vandalism, or perhaps even arson.

The writers of South Park don't desecrate other peoples property. This kid desecrated someone else's property....an important element that you are ignoring.

An important element that you're missing, Heywood, is that this is incredibly petty and is obvious pandering to the Christian community. It's. A. Fucking. Statue. For. Fucks. Sake.

And what permanent damage was done to the statue to make that even a remotely adequate comparison, please?

So would you prosecute everyone who takes those kinds of photos with statues- and there are more than a few- or just those statues that you have a hard on for yourself?

Oh fuck off, no damage was done, and if there had been the charge is not blasphemy but destruction of property, it would be the same if it was a mail box. "Desecration" in the context of this fucked up dark age law is a blasphemy law.
They are not charging this kid for property damage they are charging him for picking on Jebus.
You want to live in a state with blasphemy laws go move to Saudi Arabia or Iran.

If it were a non-religious/secular statue...would so much of the general public be outraged? Probably not. I think it was in poor taste, sure--but jail? lol
Yes, because our tax dollars have no better purpose.

This should be dismissed as "Cruel and unusual punishment."

My first thoughts on this are that if it warrants prosecution it should be handled as a civil matter and not a criminal one.
I'd be curious to read that law too. I suspect whatever it is, is either a violation of the right to free speech, freedom of religion or both. Trespass is another matter. But the photo does nothing more than prove his presence on church property with regard to trespass.
(September 26, 2014 at 1:16 pm)Heywood Wrote: The kid is guilty of desecrating someone else's private property. That's clear from the picture. The people who erected the statue....who presumably once found inspiration from it may now only think of that desecration instead when they view it.....so in a real sense the property owners have been damaged by being deprived of the inspiration they once had.
What right does the kid have to do what he did? Free speech doesn't apply here because free speech doesn't give you the right to use someone else's property to make a point. If I used an image of Micky and Minnie Mouse hot boxing to promote the legalization of marijuana, Disney would have a cause of action against me.
I still think it silly to prosecute this as a criminal manner, but if the owners of the statue wanted to take the kid to court....I don't have a problem with that. The state should uphold the property rights of property owners.
Um, did he hurt the statue. Smear it with paint? Break it? He did not.
It's trespass. Anything else is covered by free speech.
If someone walks onto my lawn against my wishes, it's trespass. Flipping me the bird is disrespectful, but doesn't add to the crime.

Absolutely, moreover if it's your lawn, then you will be the one pushing the trespassing charges against him, not some random schmuck with no connection whatsoever to you or to your lawn. In this case however, the actual owners of the statue don't seem concerned at all.
Jail is too much in this case, it's not only a wastage of the taxpayers hard earned money, but a flat out abuse of power.
Though I agree with one thing, public BJs are not a good thing, even if JC is involved.
