But what if an atheist used his superior intellect to figure out a way to avoid prison whilst doing all sorts of evil. A man with religion still has hell to worry about and may refrain from taking advantage of such a situation because of hell, but there is nothing to stop an atheist.

That's right, the atheist will use the fact that nothing is there to stop him to kill all the theists, and use his superior intellect to make those deaths so hidious that no future generation will ever be tempted to take the theist path again. So watch out, we are coming after you almost like we are a fanatical religious mob or something.
