This may apply to moral duties, but there's more to morality than just duties. No matter how you slice it, the prohibition of immoral acts is not the lack of an appropriate moral duty. The two aren't on the same scale. There exist immoral acts which do not betray any positive duty, unless you're just defining the moral duty ad hoc as you've done here. I know you're not a physicalist, but what's lacking in the rapist is a brain which would not do such things. But having a brain which would not do such things is not itself morally good, it's neutral. There is no moral duty to be "non-rapey."
The moral duty is to cultivate virtue in ones own self so as not to commit sins of either omission or commission. Its not neutral to form the habit of doing the right thing.
