I feel like you didn't really answer my question.
In the context of the hypothetical:
Are you suggesting that sex with a woman be a legally binding contract that the man accepts to house the baby if the woman is incapable?
So again, what happens if the man has sex with the woman, she gets pregnant, and it turns out she is incapable of housing the fetus for medical reasons. The man then says "fuck off, I'm not doing that".
What are you going to do?
Specifically what do you want the law to say about a man that gets a woman pregnant and then refuses to house the fetus when the woman is unable to.
A woman could do the same thing. Tell them to fuck off when they say she cannot abort and use some other sick method to kill the fetus. It's not practical to restrain the kind of people to bed and force them. Only way would be to give them appropriate punishment. Now if you're going to ask me "what punishment?" then I don't know. Whatever punishment they deserve.
