There are a few exceptions to that rule, one is a fatal transfer, where the body dies upon transmitting the brain's electric field to a machine, if your body dies while the electrical activity in the brain is transferred physically from one location to another then the synthetic brain is very much "You".
Also, were it the case that you had a connection with the digital mind the entire time and experienced both simultaneously if one component ceased to function the "You" would still be in the remaining structure.
Essentially, if our consciousness is an ever changing structure of electrical activity then any evolution of that system in any medium is still the same "person", just as much as myself 20 years ago with a brain that was similarly substantially different was still 'me', unless you're of the opinion that the me of two minuets ago is no longer the same person, then any fork in the system would create 'me' and 'him' just like time created systems that vary due to operation and experience.
