The Vatican has had Permanent Observer status within the UN since 1964.

And even if you can easily discount the Vatican’s claim to nationhood, it’s surrounded on all sides by Italy, and even then, there’s no guarantee they’d participate in a RICO case against the Pope.
Observer status isn't a recognition of statehood. The ICRC is an observer since 1990 yet nobody's arguing the Red Cross is a country.
