We don't see the rest of the story.

The guy explains to the cop that it's an emergency, and he so desperately needs a bike, that had to take the one in front of the police station, even though he knew it was a risk.

The cop buys the story, releases the perp, and lets him off with a warning.
Then he gives him the bike, tazes him, and sends him on his way.

So, if he is in need of help, he should have gone in and talked to the police instead of trying to steal the bike. If what you say is true, he is lucky, but technically he should have been charged.
