He wasn't "parked" - he was in an active drivethrough lane! And he also did not claim to have "pulled over" due to being intoxicated, when questioned by the officers! You'll just say anything won't you!

Yup. But it’s unusual for cops to make an arrest in those circumstances. Not unheard of, but not terribly common.
Even the laws against public drunkenness are rarely enforced unless the individual is incapacitated or being a bunghole.
