Driving away from your money seems like abandonment to me since you went to the ATM and pushed all the appropriate buttons to get money. The entire purpose of being at the ATM was to get money. But instead of taking the money you left.

There is no cutoff amount, other than the one distinguishing between petty and grand larceny. Lifting $60 from an ATM is no less illegal than lifting $1000.
I agree that Brian did a stupid thing by going off and leaving his cash behind, but that’s immaterial. Suppose he’d left the keys in a car with the engine running (another stupid thing to do). Is it really sensible to think that he’s abandoned the car and that it’s anyone’s for the taking?
