I think the law should default to empathy of those with less, and punish those with the power when those with power abuse it.
A good way to test critical thinking is with a hypothetical, so let’s try that.
Suppose the actors in this case were reversed - George Floyd is a black cop with years of experience who deliberately and callously choked a white suspect - Derek Chauvin - to death. Floyd, after a long trial with intense media coverage, is sentenced to 22 1/2 years in prison. All the other facts if the case remain the same. Now:
Would you say Floyd should have gotten the maximum sentence of 40 years for abusing the public trust, or should he have gotten a lesser sentence because of the unarguable injustice of law enforcement?
