Question: Why is it acceptable for you - without any supportive evidence - to guess that the cop drew his gun with his finger on the trigger, but not acceptable for me - without any assertion of fact - that what happens in the video looks like a murder?
Try this: when Sonny Corleone got shot on the causeway, did it look like a murder?

Because if you look carefully - in the video - it appears his finger IS on the trigger - and not alongside the frame - as it should be.
We have a dead guy - that's not in dispute. The cop, shot him in the back of the head. Again - not in dispute.
What you DON'T have - for it to be murder - and don't muddy the water with "it's not a charge" -- is anything to suggest that the officer did it INTENTIONALLY.
You need that, for murder.

You have MORE evidence that it was NOT intentional.
The officer followed all procedures - right up to the killing.
He was polite - asked the guy to get back in the car.
When the guy refused to comply - the officer attempted to cuff the guy.
It went to foot chase, to wrestling match - to officer attempting to use taser.
FINALLY - HE PULLS HIS WEAPON - and from what I can see (and I did say this was just my opinion - not fact - in the OP) - he did it wrong.... Things went downhill from there.
I'll bet he says "The gun just went off". Just like Alec Baldwin.

Is he guilty of something? Sure. Manslaughter is my guess.
Not - as far as I can see - murder, or an execution.
