An agreement should be in paper. The man should be able to file, but he gives up all parental rights, in that case. Actually, men can sign over parental rights as it is.
Dads do get the shit end of the stick. The difference between my child's biological mother's child support (she has no custody) and the child support my brother and law pays with partial custody is $600 a month for one child around the same age in the same state. It is a very biased system.
