He's not, it does (at least in this case, in Utah). Notice that in this instance the process of insemination itself was voluntary and yet still constitutes rape (because of the specifics of the agreement). Rightly so. He appealed on both his sentence and the length of his sentence. The convictions and terms were not overturned.
