Depends on which nation you're in, and what status you're going for. Marriage is, as you said, what you decide it is. If everyone decides it's a commercial/statist thing...well, then, it's a commercial/statist thing, as according to those who hold to that perception, right?
I know it's a legal status in the US, which is the actual point of contention for gay marriage here. Well, ok, also the fundies and evangelicals shrieking about it being wrong and them having far more voting power than most other groups, but also because the tax writeoffs and breaks which were designed for child-rearing. Which I always found a weak argument in and of itself, given how many gay couples tend to adopt...
