The government is forced to abide by the requirements of the Patriot Act. The Koch brothers aren't required to apply for subsidies they claim to be against.

No, they're taking the subsidies because they're hypocrites. They're not required to do so, and if they truly believed what they espoused then they could simply give the money back.
But they want to eat their cake and have it, too, and bank on people believing their words, not their actions.
Principled people don't bend their beliefs because it's profitable.
