Indeed it could. I've been known to be wrong. I don't think I am in this case, but reading what he's written, he doesn't seem to be speaking from a personal perspective.

I didn't say that this supported his charge. I said that as a rhetorical device it is acceptable if the writer can support his charges. I don't know your views on race, and I'm not interested in calling you racist. If you think that I'm supporting his labeling you as a racist, please accept my apologies. I don't know you well enough to say one way or the other, and I don't level such charges lightly.
I'm not supporting his charge against you. I'm saying that not every use of the word "nigger" is a slur indicative of the speaker's bigotry.

Again, where did I write that he "absolutely needed" to use that rhetorical device? Restrict yourself to what I've written and do not impute views to me I don't hold. This conversation will go much smoother.
