Youth and innocence are indeed - in most cases - mitigating factors. In the case under discussion, however, the subject has been given ample opportunity to move out of youthful innocence and into productive maturity. Unfortunately, some species are finished as soon as they leave the starting gate. Stubborn, willful refusal to take advantage of evolutionary pressure makes the current case one of those non-starters.
