Firstly Roe vs Wade needs to be overturned before the federal government can be able to enforce such legislation. You are lucky to have an activist court system in the United States. We don't in Australia and only state (mine) has legal on demand abortion. Indeed in one state they actually tried a couple recently for having an abortion.

Also I do not know if Mitt Romney really holds the exactly same views as Rick Santorum, let alone be willing to put such policies into implementation if he was president.
