The point of calling him a drunk driver is to maintain that he was a danger to others. In this thread or on that street. Because then, shooting him in the back might not be quite as bad.

Some Googling around looks like if you are behind the wheel and the keys are in the ignition and you obviously drove to where you fell asleep, you can in some jurisdictions be charged with DUI. If the car is running I would say it's pretty clear that you got the car there by driving it. There wasn't anyone else in the car.
I am just trying to make sure I have the facts correct. You stated earlier that he had pulled over. Pulling into a drive-thru isn't the same as pulling over somewhere.
Either way, he didn't deserve to be shot and killed.
