These blasphemy laws were put in place way back when under British rule- we are talking 1860 at least.
Lets blame the Brits! The hardliners are clueless- just use this as a tool as its evolved.

Re the OP: even if a 'crime' has been committed under local laws, isn't it patently obvious that the perpetrator shouldn't be held responsible for her actions? Is the concept of mitigating circumstances so very alien?
