What breach of contract was that? Anyway, this wasn't about her right to sue, this was about their right to say what they wanted.

No, not everything is a free speech issue. If I am a guest in some hotel and I get verbal abuse from the staff damn right I will sue their ass. The breach of contract is her paying for a service and not getting what she had asked for. She as a guest should receive 2 things:

1: A room that as you enter looks and smells and feels like you are the first guest ever to sleep in it.
2: A hotel staff that is right there when you need them, and near invisible when you don't.

Failure to comply with either rule and you have every right to complain and sue if you are not compensated properly.

I see you haven't done much traveling because some low rent places provide neither of those two things Smile . The owners of the establishment were assholes exercising their right to free speech. The only grounds for litigation would be a harrasment claim and I imagine it would be a hard case to win.

The two things you mention should be important to any hotel manager but it is possible for a hotel to differentiate itself through extremely low cost which would lead to lower standards. The choice is up to the customer as to what they are willing to put up with.

Bullshit. You are the customer, you don't have to put up with any of that shit. This case would be a slam dunk. I've gotten my money back and better due to the lack of service, and so can she.

Ahh, but was that through litigation or due to a shrewd decision by management aimed at keeping your business? Just because something is settled before it goes to court does not have any bearing on whether you would have won in court.

I've done a bit of travelling too.In my own country and others. You're right.In fact I think you've understated what is implied in the contract between hotel guests and hotelier.:Eg includes safety (fire escapes,building up to code etc) and the hotel must be as described in any signs or brochures. Not sure about how one defines 'clean'. I'm satisfied if the place is at least as clean as my own house,with fresh linen. The bathroom must be spotless.

Of course consumer legislation varies between countries, even states but I think not being abused is a pretty basic part of the contract. I'd have sued his arse too.

The dozens of hotels and motels in which I've stayed have been pretty much as you say. The exceptions are private back packers' hostels. Some of these establishments can be best described as 'toilets'. (In one place in Dublin I wasn't game to take a shower because the bathroom was so filthy.)

One of the hotels I stay in the most is in Bad Nenndorf in Germany. It has furniture that could easily be 20 years old. But when you enter the room it looks like it came straight out of a time capsule. The carpet is a bit worn out, but the rooms themselves are fine. That hotel costs 80 euros a night including breakfast.

I went to a hotel in Milan in 2007 which was a converted castle near the airport. The room was awful, the food was horrendous, the service was way under par, and the shower looked like the soap was smeared on the walls with a spatula. That room cost 240 euros a night. When I complained to the manager they gave me that "what are you complaining about" attitude. 3 days later they got a letter from our companies HR/legal dept with some photos I took on my cell phone.

I've had similar experiences in France and Denmark, though not as bad as the Milan hotel. Both of those hotels did the right thing, checked what I claimed was wrong, apologized for their mistakes and gave me a discount on the final bill.

Other hotels I've stayed in I've actually been amazed at how well the hotel functioned for such a low price.

Backpacker's/Youth hostels will be of lesser quality, but even there there is a minimum standard to keep. But the article specifically stated hotel, so I don't think this was a Stayokay they were residing at. And I've stayed in Youth hostels in the Netherlands and Belgium. It's very basic but for the most part quite hygienic.

seems to me the lawsuit was just a way to bring attention to this pair acting like asses. Whether or not they had a case or thought they could win is beside the point. They were trying to hurt their business with bad publicity.
