How could non belief even be a crime if your god pre-planned people to disbelieve and knew ahead of time they would disbelieve if he is omniscient. I think KoG is trying to point out the distinction between disbelief as an active belief against to proposition - such as antitheism - and non- (or un-) belief as in lacking belief and/or the capacity to believe, such as atheism.
Additionally, should he at any time go down the route of confusing the two concepts himself, ie stating that atheism is disbelief rather than unbelief, we should be in for an interesting demonstration of man-made karma. You reap what you sow, after all.
