I completely agree with you, with two caveats: I am not against the father in any way. If he was in contempt of court, so be it. A couple of hours in the courtroom lockup remedies that. Also, we don't know what he said. The news piece only says that he admitted to saying something inflammatory, was given six months in jail for contempt of court, and then started screaming at and insulting the judge, who then doubled the sentence.

None of this is good for the victim, which should be the sole focus for our court system in this case. Sending her father away for a year whilst simultaneously dropping two of the more serious felonies against her attacker---not good for the girl. At least the man will be tried for lewd molestation of a child under 12.

You know what in my opinion it doesn't really matter what he said. He could have said whatever the fuck he wanted, but all that should have happened is that he was thrown out of court. It should have not affected the case, and most certainly he shouldn't be in jail for a year. Have we forgot what the purpose of jail is? I thought I was living in the america where Jailing people was in an effort to preserve safety, and isolate people who posed a potential threat to the general public. What threat is a single instance of cursing, or even making direct attacks, one instance is not enough to warrant jail, unless we are locking him up on the grounds of speech, to which freedom plays no role.

And for god sakes, even if he's to be put in jail, handle it AFTER, not during the god damn fucking case.

No sorry, this is the way our system works, and while not perfect by any stretch, we are not a mob rule society. We have courts for a reason, and the accused have constitutional rights, including the right to a lawyer and the right to face their accuser. We cannot allow our emotions to rule us as a society, it is ok to be angry about the nature of the charge, any parent would be, but it is not ok to blame the system every time an outcome doesn't go your way.

From what I've heard, the judge was a partner at the law firm where the defense attorney works. Which seems like it should have been a conflict of interest.

Pretty sure I'd have said a lot worse to the judge and defendant than the father did if one of my grandchildren was molested. Then again, I'd probably have made sure EVERYONE knew what a slimeball scumbag the ex-cop was, and made sure nobody wanted to do business with him or speak to him, and especially not let their children around him. Regardless of the justice system.

I've mentioned this before, but there was a local case regarding abuse of school girl by a teacher. The teacher destroyed evidence and GREATLY mitigated his criminal penalty.

I would like to think the penalty for destroying evidence in a case would be pegged to the penalty of the underlying crime, but in this case, that sure isn't what happened.

Additionally, why isn't the demonstration that evidence was destroyed by the perp considered (strong) evidence of guilt, on par with victim testimony ?

(I mention victim testimony in this case as the prosecutor was unable to call the victim as to her resultant mental state from the abuse (which should also have been presented as evidence but apparently wasn't).
