Bill Cosby Case: mistrial
#11
RE: Bill Cosby Case: mistrial
Obviously the cops did a lousy job of collecting enough convincing evidence. Cosby is lucky. 70 years ago a white women would only to have claimed he whistled at her and he would have been lynched by midnight.

I'm not sure processing a rape kit 15 years after an assault is going to do much . . .

Cosby worked out a great (for him) MO in perpetrating his crimes. Hell, his wife is still standing by him (not that there is anything wrong with that).
The granting of a pardon is an imputation of guilt, and the acceptance a confession of it.

He may have gotten away with rape but it is the responsibility of the government to convince a jury before they take a persons freedom away. Maybe they will do better on the retrial.

Despite the 59 (IIRC) other accusers, retrial will still proceed as though it's a first offense.

Is your objection specific to this case, or all cases impacted by statutes of limitations ??

BTW, in cases like this and as well as child abuse cases, I have no problem with legislatures re-evaluating existing statutes of limitations. In fact, I remain AMAZED that since the first wave of pedo priest abuse from the 1980s, so many statutes of limitations remain still unchanged.

Hard to dump all this on Cosby when literally thousands of legislators across the nation have FUBAR'd this issue for decades. I might even cast a stink eye at the voters for perpetuating those same legislators careers.

Looks like we have the governance we either deserve or have earned . . .

I don't really have an objection. if Cosby did this then he deserves to go to jail. I also don't think there should be a statute of limitations on rape. I think it is a crime equivalent to murder. I am also against taking peoples freedom away without convincing evidence. So , the numbers of women claiming he did these crimes would perhaps be evidence if the statute of limitations was not a factor.

And the statute of limitations ain't the worst of it.

It's conceivable should Cosby eventually be acquitted, he might have grounds to sue his accusers (and their lawyers) for big $$$$.

The Catholic Church hasn't been shy about suing accusers, BTW.

And these outrages don't happen in a vacuum. It takes the concurrence/acquiescence of voters and elected officials to continue this kind of goddam shit.

The statue of limitations also serves the purpose of protecting someone from having to search for an alibi 20 - 30 years after the fact. If someone you knew in high school suddenly claimed you raped her in the gymnasium bathroom 20 years ago how would you go about collecting an alibi? Could you remember who you were with and could you find them after 20 years?
Even a man is innocent until proven guilty.

Good point! But searching for an alibi 30 years after should not be an issue. The claimant must provide the evidence. We atheists tout this everyday on this forum. You make the claim , you provide the evidence.

This is the unfortunate thing about prosecuting sex crimes: the longer you wait, the more it becomes a matter of just one person's word against another's, and, without other hard evidence (even if there's a demonstrable trend) this is a very unfortunate case to make for either side. I suspect this may be part of why there is a statute of limitations on such a crime, despite how heinous they tend to be. Really, the best way to even try to get justice is to report as soon as possible, and, given that the trial (and the lead-up to it) can be just as traumatic to the victim as the actual event, this does suck and I can't be sure it can change.

And you don't have to tell me twice that the sex-crime sentencing laws we have are FUBAR.
