As far as I am concerned - the jury got it wrong.

Twice.

First -  the jury convicted her of murder. Wrong. It was manslaughter. Murder - first and second degree - there has to be intent of killing the victim... You need a reason - other than self defense. This person pissed you off and you want to clean their clock. 

Manslaughter - you killed somebody - but not for any reason. It's accidental - but gross negligence is involved...


Secondly - she got 10 years. She could be out in 5.

That's fucked up. She hosed up and killed somebody. She should have got 20 years - parole possible after 15.

So you are saying despite the fact you think her crime was much less serious, she should be punished much more seriously for it?

1. In Texas 2nd degree murder does not require prior intent to kill.  It only requires death to have been caused by an act which itself is wrongful.   So if you think drawing a gun is wrongful when retreating would diffuse the situation, then shooting and killing someone with that drawn gun is murder.   


2. Federal sentencing guidelines say manslaughter warrants 10-16 months, not 15 years.

1. 1st degree is prior intent. 2nd degree is spur of the momentb with intent.

2. Nice try. Max sentance for manslaughter in Texas (this is not federal) is 20 years.

Well, she admitted that she intended to kill the victim, so if that's your definition of murder, then she murdered him.

Regardless, if it's manslaughter or murder (which I don't really see the point of getting caught up in that argument), she killed a guy and is probably only gonna' do five years for it. She took a life and is more than likely only going to serve five years. Ten, at the most, though I doubt it, and you should doubt it too if you know anything about how prison works.

Also, what the fuck was with the judge hugging her? I found that to be pretty inappropriate.

When all is said and done, it's insane that she only got a ten year sentence. For taking someone's life. I applaud the family for how they've carried themselves throughout all of this.
