And meanwhile, here's the instructions for manslaughter. And looking at the "Culpable Negligence" section really got me thinking:
That 911 dispatcher (not quite the legally binding words of police, but still) telling him to not follow Trayvon Martin would seem to support that last sentence.

And, yes, there are many lawyers who would agree with my interpretation.

Of course, it may not be as easy as reducing the charges to manslaughter, especially given that, in the original trial, he was charged with Second Degree murder with a lesser included offense of manslaughter. And he got off on both charges.

Yeah... so like I said, I think the Zimmerman case fits the definition for the Florida statute for 2nd degree murder. The prosecutors felt that way at the time and still feel that way.

I think the issue was the stand your ground law, which basically says, if we apply it to the Zimmerman case, that if Zimmerman felt threatened by Martin, he had every right to shoot him dead.

I used to be a proponent of the stand your ground laws... until I saw how it was used and abused by assholes who wanted to pick a fight and then use their gun on someone, i.e. bullies. Look up the Michael Drejka case. Now, should Markeis McGlockton have shoved Drejka, unprovoked? No. That mistake of trying to be a tough guy cost him his life. But does that give Drejka the right to shoot a man - just because he was shoved? No. Not in any world I live in.

Anyway... back to the main point... I think it's a trope we hear all too often, "They were overcharged!", and I'm just not convinced that there's any merit to the idea.

Funny that the same people who INSIST they need a gun to protect themselves in case of an armed shooter... are also the ones who tell people "Don't go after an ARMED shooter! That's just stupid and asking for something bad to happen!"

When it's themselves: "I need a gun to protect my family!"
when it's someone else (especially when they're black teenagers): "They should just call 911."
(Nevermind that a 9/11 call probably gets Trayvon Shot by police)

I bet if Trayvon did have a gun, and shot the dude who was stalking him, he'd have been fucked over anyway. Call the police when you're black, and there's an even chance the police shoot you. Just being out in public while black is a risk sometimes. Hell, being indoors while black can get you shot in some places, apparently.

And how was Martin to know that Zimmerman had a gun? Was Zimmerman flashing it about first? Or did he wait until he was getting his ass handed to him by a seventeen year old to use it? Once again, I ask, do you think it was okay for Zimmerman to shoot, just because he was getting beat up?

Don't get me wrong, I'm an advocate of the second amendment. It's one of the few conservative positions I take (though it's sad that we even consider it a conservative position in the first place), and I've defended myself in situations where other people had guns, on more than one occasion.

You know what else I've done?

Walked away from plenty of situations where I was physically assaulted because I knew I had a gun on me and that things could've turned out far worse than just me getting punched in the face a couple of times.

Martin was just a seventeen year old walking home from the corner store who was being harassed by a grown adult with with a firearm...

Well, I'd have to disagree here. Being someone who's actually used their firearm, lawfully, to defend themselves, I would never recommend that someone else do anything other than call 9/11 and try to avoid the altercation unless absolutely necessary. This is for a couple of reasons...

1. I don't know how comfortable you are in potential life or death situations. Are you going to be able to keep calm when shots start flying, or are you going to panic and freeze up?

2. I don't know if you know how to properly handle a firearm.

3. I have zero information about any hypothetical situation we might be talking about... Even assuming that you can, a) handle yourself in extreme situations and, b) properly handle a firearm... Is it even plausible to try and attack the armed shooter? Maybe you only have a Glock 19 and the shooter has a fully automatic M4 with extra magazines on his belt and a .380 in his side pocket for backup... In that case, no, I wouldn't really suggest getting into a shootout with the guy.
