They were supposed to try and convict him -without- violating his constitutional rights. The initial prosecutor, now a trumpland scumbag, fucked the pooch. The next prosecutor fucked it even harder.

Okay, on the one hand, it's fucking madness that Cosby's conviction has been vacated. On the other hand:
  • Cosby's only gotten off on a technicality, and not because he's any less likely to be a serial rapist now than he was in April 2018.
  • He's 83, and apparently has poor health. At least, assuming that he's not faking being blind &c.
  • It's become abundantly clear that he's Hollywood Kryptonite, and, as far as I can tell, the only person in Hollywood who seems to be defending him at this point is Phylicia Rashad.
If it's a victory for Cosby, it's a Phyrric one, and we all know what they say about Phyrric victories.

Frankly, if anything, this is the "one more victory like this."

I suspect that he's terminally ill and that the system turned him out to die on his own dime. Of course, that may seem meaningless, but in general, terminal prisoners cost the average taxpayer a lot of money...more so than continued incarceration of a "healthy" prisoner. Was he in a non-government-run prison?

Well, given that his prison was called “State Correctional Institution Phoenix in Montgomery County, Pennsylvania,” I highly doubt it. Also, it’s not because he was terminally ill. It was because the prosecutors made a mistake in using a civil deposition that he gave on the condition that he be immune from criminal prosecution, and his lawyers appealed it all the way up to the Supreme Court, and won.

The system released him because they fucked up massively and are now compelled by law to do so.

On the one hand, you’re right. On the other hand, he’s a serial rapist who’s not only likely in no physical condition to do so again, but has been (rightly) made a pariah by his old industry, and the media circus surrounding his crimes means the world is well aware of what he’s capable of now that he’s out. Best case is it’s OJ Simpson all over again. He’s out, but nobody wants anything to do with him. And the evidence is leaning far further against Cosby than OJ.

This was what I was thinking. There is a mercy concept in law, that when the courts determine that a convict is terminally ill and cant be a physical threat to others they can often grant a "mercy" release. I would not be surprised that Cosby is on his last leg.

Cosby's own fucking lawyer fucked him.

Should be a lesson to everyone.

You mean the deposition that was supposed to be sealed?

https://www.npr.org/sections/thetwo-way/...e-to-light

Quote:The simple answer is that after accusations of sexual assault re-emerged against Cosby, the Associated Press asked the court to unseal the documents and the court agreed.

Legally it's more interesting. U.S. District Judge Eduardo Robreno issued a 25-page memo outlining his reasoning. Here's how he explains it:

The court's rules state that unless there is an objection, documents filed in the court will be unsealed automatically two years after the conclusion of litigation.

When the AP filed a request to have the documents unsealed, Cosby's attorneys objected, saying it would violate Cosby's right to privacy by making public, among other things, "intimate knowledge about his sex life." Cosby's lawyer also argued that the release would embarrass Cosby and would violate the confidentiality agreement signed by the two parties.

— Robreno dismissed all those arguments.

Perhaps the most intriguing part is that Robreno concluded that Cosby should be thought of more as a public servant. Previous courts have held that public servants, or politicians, give up some of the privacy protections afforded to regular citizens or even public figures.

So in order to unseal the deposition the Judge had to perform some serious mental gymnastics in order to portray Cosby as a public servant.
