Nebraska Gov. Pete Ricketts said during his Tuesday news conference that he would not prohibit the carrying of weapons in the state Capitol because of the second amendment. Ricketts said the Nebraska Capitol building would remain open next week despite FBI warnings of potential threats at all 50 state capitals and Washington, D.C. surrounding the inauguration of President-elect Joe Biden. The governor said no ban on guns in the state Capitol would be considered, answering twice that it was a violation of the 2nd Amendment. “It’s a Constitutional right, the second amendment,” he said.
Encouraging peaceful protests, the governor did acknowledge that Nebraska has an open-carry law. “Please protest peacefully. Also, be thoughtful there are people here who are nervous when you bring your guns out, so be thoughtful of that as well.”
That's good advice, considering how thoughtful and considerate people are who bring guns into legislative offices during a time of heightened political tensions.

Stay home that day, bud. It's likely to get stupid.
I dunno...
I know everyone gets all panicky at the sight of a guy with a gun - but -
How many protests where protestors carried guns into a state capitol ended in gunfire?
It's not a recent development you know....
Anybody know of any cases?
And if you say "Last week in Washington DC "- you best remember who was the only one to fire - a Capitol cop.....
No protester fired a round.

He's demonstrating a shocking lack of knowledge and understanding of the Constitution. It doesn't guarantee anyone the right to take a gun anywhere they want. Or it's just more Trump-style lies.
Why is it so?

The closest thing I can think of is the assassination of Huey Long in 1935, but while I concede that the vast majority of protests with guns end with nary a shot being fired, the context behind these new protests is very different. Namely, that they were hoping to actively overthrow the government. This is not something you want to take chances on, even if the one person to get shot in the Capitol riot was a rioter shot by police.

Nothing to do with the Constitution. While the SC have repeatedly affirmed that owning firearms is a constitutional right, the actual details of how that right is implemented are (largely) left up to the States. In this case, if the Nebraska courts and legislature have decided that it’s legal to carry firearms inside the state capitol, that’s how the Constitutional right works in Nebraska.

To date - like it or not -Trump is President. To overthrow the government you would have to overthrow him.
They were trying to prevent transfer of power to a new government.
Big difference. One is sedition. One is not.
Both are however - illegal - and subject to penalty..

DOJ's official position is that it was sedition.
Do you believe what you do because you consistently get the facts wrong, or do you consistently get the facts wrong because you believe what you do?
The domestic terrorists were trying to overthrow the us government. Donald trump is not the us government. That, is an article of your own belief, not fact. In mere reality, and as a matter of fact - donald had recently been overthrown without the slightest whiff of sedition in a thing that we americans call voting. Granted, the donalds men very much believe that this was the real crime.
No edition, no sedition, you're the sedition - and everyone agrees that it was a perfect phone call.

Jesus are you fucking dense......
Just because some drone from the DOJ SAYS something doesn't make it a fucking fact that you can glom onto and expect to be reality.
They can prosecute alleging it's sedition - but a jury has to be unanimous in agreement with that allegation.
Guarantee the defense will use the arguenent I set forward and probably a few nobody here has thought of...
If the jury doesn't convict - and it only takes one to vote aquittal - you don't have sedition......
But I'm sure you will keep barking it...
