In fairness, this idea applied to a culture where a widow's situation was so bleak that an available single man who cared about his brother and her husband would not normally feel decent about not marrying her.
If you were that brother in that culture, then this would not stop you from marrying who you like. Monogamy became an ideal in Judaism since the Jews returned from Babylonian exile, but it was not enforced and probably would not be expected in such a situation.
