On the latter, I seriously doubt that the consensus of the mental health profession would agree with you.
Anecdotally, my psychologist worked in the prison system for a number of years, and I guarantee she disagrees. Also anecdotally, I have had no problem refraining from the evil behavior (i.e. anti-social or harmful to self or others) I engaged in while ill now that I'm not.
On the former, sure - people need to be held accountable, if for no other reason, but to keep the rest of us safe.
