Maybe if the kid suffered injuries when the cops physically moved her legs into the car (ideally in a way that’s no more forceful than absolutely necessary to get her legs where the rest of her body was), then maybe arguments from personal responsibility of the victim might have a place in this discussion. Point is, the cops’ response was disproportionate to the actual threat: an emotionally disturbed nine-year-old girl who’s already been handcuffed and put in the car and only has to get her feet there as well. I don’t know what circumstance would justify pepper spraying a nine-year-old girl (maybe if the kid from The Bad Seed ended up in a standoff with the cops and she ended up in a “cornered beast” situation?), but this ain’t it.
