How he 'KNEW' is because he saw that the guys finger was not on the trigger, if the gun fires without your finger being on the trigger, it is an obvious malfunction, he is LITERALLY standing right there looking at the guy handle the weapon. Hell, you can see his finger is clearly resting on the side of the weapon just before he inserts the magazine.

If he made it from existing parts, the serial number of the frame would still be on it. I have a .22 carbine that has had everything but the barrel and the housing for the action replaced. That housing still has the serial number on it. Not a ghost gun. If you've read a lot of what OLB posts, you will know that he interfaces with law enforcement on a regular basis, as they use his gun range. I'd expect at least one of them to take exception to any unlawful weapon that he possesses.
