How he 'KNEW' is because he saw that the guys finger was not on the trigger, if the gun fires without your finger being on the trigger, it is an obvious malfunction, he is LITERALLY standing right there looking at the guy handle the weapon. You are seeing the guy from his left side and he is shooting it right handed. His trigger finger is obscured by the pistol - IF the lighting was good enough to see - which it isn't.
