The whole premise of this OP is hung up on semantics.
So you are apparently of the mind that this was manslaughter, which is defined as killing without forethought and malice, yet the officer pointed his gun at an unarmed man who was moving AWAY from him and popped a cap in his head.
I do not see this the same way you do, that is clear.
