That was to be expected. Appeals rulings generally come with a hold when a further appeal is likely.

I may be mistaken on this, but it is my understanding that the likelihood of prevailing on appeal is also taken into consideration.

As a matter of law, this appears to be DOA, but with this SCOTUS, who TF knows.

Part of me thinks that they might uphold Trump's idea, but the rest of me knows that even the Supreme Court, as corrupt as they are, would know that this would be a horrifying precedent to uphold into law. If nothing else, it would mean that if, say*, Biden found one of their rulings to be particularly unpalatable (perhaps even this one), he could just call up SEAL Team Six and just have them killed and, assuming that enough Democrats in the Senate viewed this as some sort of necessary evil, he would legally be 100% in the clear.

* And let it be known that I don't think this particular scenario is very likely with the Dems, especially with a President as milquetoast as Biden.
