I forget what police call it when they charge you with DUI after the event, it typically happens when you leave the scene of an accident without reporting it, but legally it can happen in other situations as the above example too. You can also be done for DUI while you're in the hospital after the accident - and in fact I know someone this happened to recently, and they've lost their license (as they should have).
