I certainly wouldn't know.
In a court limited to incomplete knowledge, I would convict the man of murder.
That has no bearing on the ultimate justice of the man's actions. Only a perfect judge could know that.

But why not just throw up your hands and say, "I can't determine reality from cruel fantasy one way or another because I don't have perfect judgment." Wasn't that your argument for killing children in the name of God? You don't seem very consistent.
