The only problem with the Satanists' argument is that the ten commandments has a plausible rationale as a representation of culture and tradition where a statue of Baphomet does not. That argument however is undermined by the fact that such representations of the culture and tradition of law and morals in the U.S. end up being exclusively Christian, and a complete absence of representations of the Code of Hammurabi and other historical contributions to our tradition and culture is evident. The logical defense of that is that our culture has been largely Christian so it makes sense that relevant cultural traditions to be memorialized would be Christian. However, it's not clear that this defense doesn't support rather than undermine the contention that a plaque of the ten commandments is not religious, but essentially secular and neutral. It clearly appeals selectively to one segment of the population to the exclusion of the interests of other segments of the population.
