Example let say a "very mature" 10 year old boy is 'raped/molested' first sexual experience with a 17 year old female baby sitter. by every measure of the law this is rape, but the boy was happy and the baby sitter was cool with it too. So should the girl get a 10 year prison sentence and be labeled a sex offender/predator for a child under the age of 12?

Rape isn't because of some cosmic battle between a sky hero and a ground troll making bets over the neurons in a perp's brain. 

Rape is a psychological need for the perp to force control over another human being. Most humans DON'T rape because most of us have EMPATHY for others. Rape in a perp can be because they can be mentally or physically abused as children, and grow up to abuse themselves. Or they can simply be sociopaths whose brains never grew with empathy. Your old book of mythology is not a scientific field like psychiatry or psychology and doesn't explain a damned thing as to why humans do good or bad.

Humans are quite fragile, even the most rambo gung ho humans get old and die, and can even be killed by a deadly bacteria, or virus, or tornado or tsunami.
