The analogy is incorrect. It is not analogous to an personal identity. The jesus image of the stature is known to not exist in that form. We know well that he was not a white European man. We have no unimpeachable evidence that he ever existed at all. A more apt comparison is a flag or other standard.

If a kid performed such an act on a stature that looked nothing like my mother, and I had never met my mother, and I had no rational reason to think my mother even existed at all, then I wouldn't be pushing to punish the kid in any way.

Then just say your position is that any desecration that does not result in property damage should not be criminalized. When you go and specify that you don't want to criminalize this particular act of desecration that does not involve property damage, it implies you take the position that you would be willing to criminalize other acts of desecration that don't involve property damage.

For the sake of argument lets assume Hovind's action constituted desecration(I don't think it did....but what ever)....I think it should be left up to the community to determine if desecration of that particular monument constituted a crime.

Personally I don't think Hovind should be charged with anything because there was no damage and he was being a self promoting idiot.

I don't think this kid should be charged for the same reasons.

1. No damage was done (apart from people being over-sensitive)
2. He was just being an idiot (and we'd all be locked up if people were arrested for that).
