If one appellate circuit sustains a state ban the SC will have no choice but to rule. If they decline to review the lower appellate decisions stand. It is a gutless way of keeping their hands out of it and not having to listen to jesus freak morons scream about them for the next 40 years as happened with Roe v Wade.

Consider: the Supreme Court hears arguments for approximately 75-80 cases per year. They receive approximately 10,000 petitions. One of the metrics that they use to determine whether a case is ripe for SC review is whether or not a controversy exists at the circuit appellate level.

No such controversy currently exists. I'm not at all surprised that they would decline to hear these cases for that reason alone.

In addition - as long as appellate courts continue to rule in favor of equality, we're winning, though perhaps not as quickly as we'd like. As Min correctly states, as soon as one rules against us, it's almost certain the SC will have to hear the case to resolve the controversy - and unless they're willing to overturn their own decision (with respect to DOMA), it would be very surprising to have that not go our way.

It's inevitable.

Michigan (where I live) declared the ban unconstitutional. So, it seems that the ruling has been upheld.

I'm curious Snyder (the governor) will respond. Originally, he kept restrictions in place while the ruling was being appealed, which pissed off many activists. There was a brief weekend when a bunch of people got married, and then he put a stop to that.

There is a myth about Newdow's "under God" suit. SCOTUS did throw it out, but stupid idiots think they said "under God" stays in. Nothing is stopping another atheist from filing the same suit legally. They threw it out because they did not want to do the right thing. They made Newdow's custody an issue to avoid making the right ruling, originally upheld by a republican judge in the 9th district. This is the same delay tactic.
