I can see that logic. Leaving behind emotional wants would be a more fair justice system. Personally I am the kind that if the person did wrong me terribly then I want real eye for an eye justice. Of course this is why I should never be in law enforcement, any court related job, or really anything that let's me have power over someone I deem bad. My question is though that if we see jail and nothing else as just punishment how does that make the person better? If someone has done something so heinous as sexual assault it means there is something VERY wrong in their mind set. Putting them in jail, a place where violence, hate, and anger rules, won't fix that disgusting desire in them. Where do we balance out the fair punishing him part and the acknowledging that he is mentally unstable?
Yup, prison should be about rehabilitation, not retribution, and I'll be the first to admit that our prison system is hopelessly, dangerously broken when it comes to that. How do we fix it? I sure as hell don't have the answers, but we certainly won't fix it by supporting castrations or the death penalty.

The thing is how do you "rehabilitate" someone as sociopathic as a rapist? I ask this question with an open mind. Putting them away for the good of society, to keep them from harming anyone again, seems the only thing we can do until we gain the technology to reprogram a personality.

That's my point exactly. I truly do not believe we are capable of rehabilitating someone like that. Robbing, being in gangs, drugs, all that can be but I don't think anything sexual or murder related can be. I see it as being gay/transgender. It is built into who they are. The difference though is that gay and transgender doesn't hurt anyone so it shouldn't matter any more than being born with blue eyes. Being built to like hurting someone or something (usually the tell tale sign is hurting animals for fun as a child but not always) isn't acceptable so what do we do with them? Do we just let them rot in prison? (using our tax dollars, getting three meals a day, and a roof over their head) Do we send them away? There doesn't seem to be a right answer.

Yes. There was a case in Portugal some 2 years ago that a father was accused by his daughter of sexual abuse. He did 10 years in prison as a child abuser (funny, there is a kind of prison justice where child abusers and rapists get a little more than they bargained for), only to some 20 years later, the daughter recanted and said she was manipulated by her mom to say that to get the upper hand on a divorce... The old dude now, doesn't forgive. A sad story all around. I have been in prison and for well proved crimes, drug related, fighting cops, et al. I only got what was coming. Well, as the judge said, I was committint crimes against mostly myself.
