So fucking what? It's not.as if the supreme Court are arbiters of what is right.

They're arbiters of what is legal.

Furthermore:

A road block checkpoint is not the same as a border patrol station. Road blocks are meant to temporarily block the road, hence the term "r.o.a.d. b.l.o.c.k.". The station in that woman's video had buildings that were permanent. That is the complete opposite of "temporary".

You act as if she had a choice. She didn't. If you watched all of her six videos, you would have known that she stated very clearly that that road is the only one that goes to her home and she was being funneled to that station with every other car.

A DUI checkpoint is not the same thing as a CBP station. They are not checking for the same thing.

The ACLU frequently fights in courts, with their own lawyers, for the rights of US citizens when their Constitutional rights have been violated. They absolutely aren't the law, but they KNOW the law and they are an organization that contains lawyers who have licenses to practice the law and they do so daily. They are MORE than just an opinion. Nice attempt in trying to downplay the ACLU though.  Dodgy

The court cases referenced had mostly to do with distances outside the limits (100 miles) or pulling people over not at a checkpoint. Neither of those apply to the instance we are discussing. Unless there is something that I missed.

What does it matter if it's temp or perm? If authorities, performing their function within their duties and the law, ask you to pull over to be checked, you pull over, simple as that. Explain why it matters if it's temp or perm.

What six videos? I don't have facebook. The eleven+ minute youtube I watched (maybe contained all 6) did not indicate what road they were traveling, or their start point. She did indicate that "I've always been waived thru", sounds like she has been there before. It also indicated that they were in Detroit MI, IN, NY, IL, PA, and NJ. I looked at all of the perm checkpoints in NM and they are all south. If shes coming from northern states and does not want to comply with a checkpoint there are numerous other roads she can take. It's not the "only way home". It appears that she did have a choice to avoid and decided not to (again "I've always been waived thru").

You're right, DUI check is tougher to get thru. You have to show papers/ID. This one, all she had to say was "Yes, US citizen".

If she would have been "waived thru" we would have never heard of this. My gut says the "protest" was more about her white privilege violation than anything else. Did she go protest when her "brown" teacher friends complained about problems with BPC prior to this? Don't know, no evidence, but doubtful.

When the ACLU weighs in on this instance then we'll talk. Until then, it's still opinion and all the ACLU is doing is pointing out the law that pertains to this incident. Looks to me to be within the law.

What did I bypass?

"Failed miserably" and "nice attempt"? Would you like to make this personal?

Straw man much?

lol. Do you even know what that means?

Look. The border patrol and pretty much every other law enforcement agency in this country does shit they shouldn't do every day. I don't like that. I can't think of anyone I know that does. I even don't necessarily agree with these border patrol check points. But your mini rants about how unconstitutional what happened to this woman is simply does not apply here. I picked that sentence out of what you posted because it was directly relevant to this circumstance. I didn't quote the rest of the paragraph because it wasn't. Sorry you don't like that but c'est la vie.

That's true. But until congress passes a law (good luck with that) that makes it illegal the border patrol is going to continue to legally operate these checkpoints. Until then if you get stopped at one then answer the fucking question and continue on your way. If you don't, and you get further inconvenienced then that's on you.

You missed an entire point. As I stated before - a checkpoint is not the same thing as a station. A station - that station in the instance relevant to this thread - is PERMANENTLY sitting on a road that DOESN'T LEAD TO ANY NATIONAL BORDER. The relevance to this is that........*oh for fucks sake*

................you really need to go back and read the entire post I made and let some of it marinate because I am not repeating again, what you can scroll back a few pages to read.

It matters because:
Quote:In practice, Border Patrol agents routinely ignore or misunderstand the limits of their legal authority in the course of individual stops, resulting in violations of the constitutional rights of innocent people.

You missed many things in the video. And it would appear that all six videos were combined into one long one.

You are clearly not familiar with the number of Canadians who overstay their visas.  Pro-tip:. It's a bunch.

Maybe give me numbers or a source, because I imagine it's a way smaller number than Mexicans fleeing Mexico. I did look it up and I got 75,000 for Canadians and 6 million for Mexicans. That's from 2009 though. Unless something happened in Canada since then to cause millions of them to flee the country I doubt there's been a significant change in their numbers.

The US has a worse health care system. which would be even worse if the republicans had their way, why would Canadians want to be worse off!

They happened often enough. Oddly enough, it was the right-wing complaining, videotaping, and refusing to cooperate.
