I think that is because that is not a constitutional right covered or granted by the constitution. Which would explain why only some have it, and not all.

I've granted a number of things, and as I've said, I don't have an issue with them saying that they can't do so without reason. It's just the liberal interpretation of the 5th amendment which I think is wrong.

You think that the administrations lawyers failed to offer any comment, because there is no right of due process, or of petition?
You're using the word liberal, again, I still have no idea what that's supposed to mean.

I think that we have freedom of speech, and I disagree with the way the decision came down, for the reasons I have given. I think that they could have taken this up the chain (above this single judge), but instead have decided to create rules of decorum so that their is a process the next time. I think that amendment that you are referencing from it's context is not talking about petitioning for a press pass. And I haven't seen much arguments as to why the context should be ignored.

The reason that you've given is that you think it's a liberal interpretation...but I still have no idea what that's supposed to mean.
If they need to create rules, so that there is process next time..then there was no process -this- time.
If there was no process, then there could have been no due process..and if there was no process, and thus no due process, how can there be a means to petition the results of no due process, from no process?

I defined what I thought it meant a couple of times. Why do you think it applies here, and not within the context of the rest of the clauses of that amendment? Also, I've asked before what law is there for due process that you think was not given? It doesn't seem to be a matter of law to me for due process under the law; also why I think it's just being shortened to only due process.

Concerning what? I have not seen any laws cited which would require due process. Nor where he was criminally charged under the law without citing anything. I also don't understand how this applies to the context of the rest of the amendment. The constitution is the law of the land. It says we have a right to due process, and a right to petition. If there was no process...then there could be no due process or petition.
One would most likely find that there is a process and an appeals process..they simply weren't involved in the decision to revoke acostas pass. It's more than a little bit pointless, imo, to argue in effect that the government followed the rules..but, at court, simply decided not to explain how they did so. Calling the decision of a federalist society trump appointee liberal, repeatedly, explains nothing about the issue at hand.

I've mostly just seen that he wasn't given due process which I have conceded, but I don't think is necessary in this case (did someone specify a process that was gone around for this)? My questions are specifically concerning the fifth amendment, and how it is being applied. And while I respect the judges authority, I don't think that we need to just agree with his ruling without question or thinking. He is only human after all.

Then that's that. If he was not afforded due process, the administration is in breach of the 5th. Because of this, and the fact that there must -be- a process to which one can appeal for the 1st amendment to be operative...they are in breach of this amendment as well.
