That probably won't matter. Remember the replacement is for a conservative justice. Currently the court is actually more liberal, especially in civil rights matters (Anthony Kennedy often sides with the liberal wing in civil rights cases).

Very true but it's possible that the SCOTUS would support Trump's EO rather than risk being blamed for future terrorist attacks in America.  Of course there will always be such attacks but if the Court is seen as an enabler it won't go well for them.  Remember, Congress can prevent judicial review if it wants to in most instances.

So, Trumps incoming approval rating was 45% and now its 42%. Anyone want to bet on what it will be on Monday? I reckon it might drop a few points below 40.

Except that didn't happen. Obama was never aware of Tsarnaev, nor did he know he was planning terror attacks. In addition, Tsarnaev didn't travel to any of the countries that Trump's ban covers, nor is he a citizen of one.

Moreover, none of the countries where the 9/11 terrorists came from are covered by Trump's ban.

For those who don't know the past six Presidents have used EOs to bar certain classes of immigrants from the US.  The Repubs used to love to whine when Obama did it and now the Dems are whining because Trump has done it.   It's a constant stream of whining that does seem to be going away anytime soon.
