California ban on high capacity magazines declared unconstitutional
There was an interesting 2nd amendment ruling today.

In short, a federal district court in California declared the state's ban on magazines with a capacity in excess of 10 rounds unconstitutional today.

We all know the founding fathers had AR-16's with 100 RPM clips in mind when penning the constitution.

The arguement of the day ( circa 1776) wasn' t for high cap mags - but if " civilians" should be allowed rifled barrels - rather than smoothbore. Rifled barrels were considered by some to be military grade weapons....


And nice touch with the emotionally charged non sequitur......Perhaps thats' s a good tactiic...

Do the courts honestly think that the armies of King George III are going to descend on Washington any moment now (the specific and sole reason any right to bear arms was granted in the constitution, and then only as part of a state run, trained and funded militia)? Or is it simply the NRA is waving enough roubles around to make them throw any semblance of legal justice out the window?

Either way it's not a good look for the US body of judges in their ability to interpret and rule on law.

Muzzle loaders. Impulsivity is a real problem with guns.

Rifled barrels were also used for hunting. Smoothbores are crap at any real distance. The Americans used their riflemen effectively during the rebellion. Didn't have enough of them. Smoothbores, on the other hand, weren't worth aiming most of the time. The command was "level", not "aim" when the troops drilled with smoothbores.

And AR-15s are also routinely used for hunting. I expect to bag at LEAST 5 whitetails with my new 450 Bushmaster this year.

Those folk that think limiting magazine capacity will prevent killings are misguided and simply use emotional pandering to present a position that " seems reasonable".

How is forcing a madman to change magazines more frequently going to help? You think a nutter is going to go - " gee - I' m getting awful tired of changing magazines - maybe instead of killing people I' ll take up crocheting.."

No - making all magazines hold 10 or less will simply make the madman more aware of his ammo capacity - and will likely make him a more efficient killer....

You would be better off ( in terms of lone gunman shooters) to mandate all guns be fully automatic - and the moron would send more rounds into the ground, walls and ceiling - gleefully spraying lead - rather than aiming at people and making every shot count.
