'Hate' is an emotion.  Not really sure how effectively you can legislate against what people feel.

Proportion of the general American public? (I.e., do you think that the percentage of people in jail is anywhere close to the percentage of people who would be acting criminally if they thought they wouldn't suffer consequences?)

I have no way of knowing that, obviously.  But the US does have laws against hate speech, yet neo-Nazi fuckwits continue their protests and marches.

So, yes, there are people who aren't deterred. Claiming that the scales tip one way or the other is fundamentally incorrect. (I learned that in my Soc. classes.)
